Mr Chakwana was convicted of raping a woman during the night after he and a friend had called at her house. He maintained the sex was consensual. The conviction was overturned due to a failure to disclose contradictory evidence given by the victim about her sex life (the prosecution argued she would not have had consensual sex because she was only interested in her boyfriend, but in another statement she had stated that she was in a casual relationship with her boyfriend and sometimes had sex with his friends). This made the conviction unsafe.
