Thomas Roony was found guilty of culpable homicide following the death of James Higgins who was dragged from his house into his garden and stabbed to death (and whose son was also assaulted leaving permanent injury). Eyewitness evidence at trial was vague (witnesses spoke of seeing shadows and silhouettes). The Court of Appeal found that “the quality, character and strength of the evidence…should have entertained a reasonable doubt as to the guilt of the appellant.”
