Sanjeev Dhir was convicted of two counts of occasioning actual bodily harm, two counts of false imprisonment, and two counts of kidnap. The case related to the assault of two brothers, allegedly over a financial dispute. Dhir claimed that he took no part in violence inflicted by co-defendants and was out of the room most of the time. Thereafter he was effectively kidnapped himself. He said that the brothers had a motive to falsely implicate him dur to a financial dispute. On appeal, new witness evidence was introduced that suggested that Dhir was subjected to force by others. The court concluded that if this evidence had been available to a jury they might have derived assistance from it. On this basis, the conviction was quashed. Dhir was acquitted at a retrial.
