Peter Cadder was convicted of assault. He had made admissions during a short interview without a solicitor. The Supreme Court held that his rights under the European Convention of Human Rights had been breached because he had been denied access to a solicitor before being interviewed. The conviction was quashed on this basis. Later a retrial collapsed, as a key witness admitted that he had given evidence at trial based on what he had been told and could not remember exactly what happened on the day of the attack, and could not identify the attacker.
