Martin McCauley was convicted of possession of three rifles in 1985. The charge was related to a shooting in 1982 in which the police wounded McCauley and killed his friend. McCauley insisted they had been unarmed, but police officers testified they were armed. Years after his conviction, a polcie investigation discovered that MI5 had a listening device inside McCauley’s shed at the time of the shooting which could have corrobotated McCauley’s account and had been destroyed. The conviction was quashed on the basis that misconduct of the police was such that it would be contrary to the public interest and the integrity of the criminal justice system to uphold the conviction.
