Jasmin Schmidt

Jasmin Schmidt was convicted of two counts of inflicting grievous bodily harm. This was based on accusations of shaking children in her care. The conviction was quashed due to findings that the judge misdirected the jury about how to approach conflicting expert evidence (specifically through saying “if…you were driven to conclude that Jasmin Schmidt caused these injuries…then it would be possible to interpret this evidence in a way that supported that conclusion”). This was described by the Court of Appeal as “putting the cart before the horse.” On this basis, the conviction was found to be unsafe.
