Christopher P was convicted of rape of his ex-partner. It was alleged that he forced his way into her house, was violent and abusive and raped her. P admitted vaginal intercourse which he said was consensual, but denied anal intercourse. At trial, anal swabs were adduced to prove that anal intercourse had occured. On appeal, new evidence was presented to show that there was a possibility of cross-contamination between vaginal swabs and anal swabs. The expert accepted this might have occured. The court concluded that it was impossible to say with confidence that the conviction would have been recorded by the jury if they had the benefit of the new evidence, and the conviction was quashed.
