Bryan Tong was convicted of sexual assault. He had been accused of sexual assault of two boys “S” and “R,” but was convicted only of sexual assault against R. On appeal, another boy, “D,” gave evidence that R had admitted the allegations were untrue. D said he had not come forward earlier as he was not aware the trial had gone ahead. Lord Justice Tuckey said D was a credible witness and his information cast doubt on the safety of Tong’s convictions, in a case that had been based on the word of R against Tong. He concluded that it was not possible to say Tong would have been convicted if the evidence had been before the jury, and the conviction was quashed.
